  1. This website is operated by Divine Corp Ltd (ViXii). Throughout the site, the terms “we”, “us” and “our” refer to Divine Corp Ltd (ViXii). Divine Corp Ltd (ViXii) offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service” or “Terms”), including those additional terms, conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
  3. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms & Conditions. If you do not agree to all the terms and conditions of this agreement, we respect your choice to not access the website or use any of our services.
  4. Our website is hosted on Amazon Web Services and powered by MedusaJS’ commerce platform.
II. SITE ACCESS & CHANGES
  1. Our website changes regularly and access to this site is permitted on a temporary basis. We aim to update our site regularly, and may change the content at any time, including the product details and pricing without notice. If the need arises, we may suspend access to our site or suspend services indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material. Please be informed that you are also responsible for ensuring that all persons who access our site through your Internet connection are aware of these terms, and that they comply with them.
III. CONTRACT
  1. No contract will exist between you and Divine Corp Ltd (ViXii) for the sale of any product unless and until Divine Corp Ltd (ViXii) has accepted your order with a confirmation email and a full payment is deducted from your credit / debit card or any other means of online or accepted payment. Our acceptance of your order brings into existence a legally binding contract between us. Only adults (as may be defined in the jurisdiction you are based in) are entitled to enter into legally binding contracts.
  2. Divine Corp Ltd (ViXii) reserves the right not to accept your order or, if the case arises, terminate the contract agreed upon between the user and us, in the event that we are unable to obtain authorization for the full and agreed payment. Additionally: (i) if delivery restrictions apply to a particular item in the jurisdiction where the product is sought to be delivered; (ii) if the item ordered does not meet our quality control standards and is withdrawn; (iii) the item is or becomes out of stock; and / or (iv) if there is an error in pricing or content, we retain the right to reject your order or terminate the contract, as the case may be. We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable for any direct, indirect and / or consequential loss, damage or expenses arising from our not accepting your order or terminating the contract for the reasons stated herein, and we shall have no liability to you by way of compensation, other than to refund the amount paid for the goods in question, less any transactional fees deducted by the transacting bank / payment portal.
IV. PAYMENT
  1. By purchasing items on our website, you confirm that the credit / debit card or payment system that is being used is yours or that you have been specifically authorized by the owner of the credit / debit card or payment system to use it. All credit / debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment, we will not be liable for any delay or rejection and / or termination and / or non-delivery. Payment modes accepted by us are clearly identified in the appropriate section of the website.
  2. All credit / debit card transactions on this site are processed using Stripe, Inc., which is a secure online payment gateway.
  3. The prices payable for ordered items are as set out in our website in GBP (British Sterling Pound). Additional taxes may be applicable subject to the jurisdiction involved. Delivery charges will be clearly displayed when selected and included in the total cost.
V. DEFECTIVE AND DAMAGED ITEMS
  1. If you should receive an item that is defective, damaged or not what you ordered, please contact us within 2 days of receipt of the item. We will help you resolve any issues as quickly as possible by replacing the item, once the faulty item has been returned to us. We will confirm the return address in writing, once you have contacted us about the defect.
VI. REFUNDS AND EXCHANGES
  1. In the unlikely event that you are unhappy with your order please don’t hesitate to contact us at care@vixii.co.uk. We remain committed to providing our best service to each of our users / customers and remain available to address your concerns.
  2. Each item / piece created by Divine Corp Ltd (ViXii) is put through stringent quality checks and adheres to internationally recommended standards. We allow a 14-day window (from the date of delivery to you) for returns and refunds for all items, except earrings due to hygiene reasons (except the Delivery Cost charges incurred to send and return the items). We may at our discretion accept returns of earrings, however we are not obligated to do so. Once you have notified us of your intention to return the item, you must post the item to us (at your expense and own responsibility), within 14 days of notifying us, returns which are not shipped within the 14-day delivery window will not be accepted. Should the item not arrive, or if it arrives damaged or in non-sellable condition (including the ViXii branded jewellery box) we will not extend a refund or option for exchange.
  3. If you are opting for an exchange, please allow for adequate time to produce and send your replacement piece. Any additional delivery charges incurred will be your responsibility.
  4. Additional Fees when returning an item or requesting an exchange might be levied. We reserve the right to charge customers an additional administrative fee if the customer requires excessive administrative time for their order, such as repeated changes to the order, or providing incomplete or inaccurate information. The amount of the fee will be determined at our discretion and will reflect the reasonable costs incurred as a result of the additional administrative time. We will notify the customer of any such fee before it is deducted and/or charged.
  5. Customers have the option to purchase pieces displayed on our website, or, alternatively, have pieces custom made as per their preference. Custom made pieces shall not be accepted for exchanges or returns and if defects / damages are notified to us on such custom pieces within 2 days of receipt of the piece, we may request you to send back the piece to us for necessary corrections / repairs.
  6. Please note that our items are handcrafted by technicians and are not mechanically produced. Our design principle is that of authenticity and celebration of craftsmanship, and therefore most of the pieces will be “imperfect by design”. These will include minor variations between each piece, or small imperfections. Please take care of your goods while using them, any goods which are damaged by wear and tear, an accident or misuse, are not considered faulty and will not be liable for an exchange and/or refund.
  7. In a circumstance warranting an exchange, repair or refund, the customer must return the piece in its original packaging to us at the address indicated to you. Upon receipt of item(s) purchased in its original form and packaging, the piece shall be assessed, repaired, or, where the circumstances warrant, the payment system, credit or debit card originally used for the purchase will be credited with the cost of the goods minus the delivery and transactional charges (exceptions may apply). We will process your request for refund, exchange or repairs within 7 working days from receipt of the item subject to it meeting our inspection and returns criteria. Your payment gateway, debit / credit card company may take 4-7 working days to credit your account.
VII. INTELLECTUAL PROPERTY
  1. The entire content of this website, including all jewellery designs, photographs, logo, copyright, trademarks and other intellectual property rights it contains, including the use of the name ‘Divine Corp Ltd (ViXii)’ and ‘ViXii’ is the sole property of Divine Corp Ltd (ViXii).
  2. You may store, print and display the content supplied solely for your own personal use and you may draw the attention of others within your organization to material posted on our site. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this website, nor may you use any such content in connection with any business or commercial enterprise. By using this service, you agree that you will not attempt to undermine the integrity of this website or its contents.

IX. AGREEMENT

These Terms and Conditions constitute the entire agreement between you and Divine Corp Ltd (ViXii) regarding your accessing our website, any sale, purchase and / or use of the items displayed / exhibited herein. This agreement supersedes any prior agreements or understandings related to the subject matter herein. No modification of these terms and conditions shall be binding unless agreed upon in writing by both parties.
